Terms of Use

These Terms of Use ("Terms") constitute a legally binding agreement between you and TWO ON DREAM Inc., a company incorporated in Seoul, South Korea ("Company", "we", "us", or "our"), the owner and operator of publast.com and the Publast application (collectively, the "Service").

By accessing or using the Service, you agree to these Terms in their entirety. If you do not agree to any part of these Terms, you must immediately cease use of the Service. Your continued access or use of any part of the Service constitutes your binding acceptance of these Terms.

1. Service Description

• Publast provides credit-based publishing: one credit allows Publast to generate an AI-written, SEO-optimized article.
• This article will be published across multiple websites owned or controlled by Publast (our "Network").
• Credits are sold on a one-off basis and do not expire.

2. Account & Eligibility

• You must be at least 18 years old.
• You must provide accurate, complete, and up-to-date information during sign-up and maintain the accuracy of such information for the duration of your relationship with Publast.
• You are solely responsible for safeguarding your login credentials and for all activity that occurs under your account, whether or not authorized by you.
• You agree to notify Publast immediately of any unauthorized use of your account or any other breach of security.
• Publast reserves the right to refuse service, suspend or terminate accounts, or remove content at our sole discretion, particularly in cases of suspected Terms violations.

3. Acceptable Use

You agree not to use the Service to:

• Violate any law, infringe upon the rights of others, or violate these Terms
• Engage in, promote, or facilitate illegal or fraudulent activities
• Publish or distribute defamatory, obscene, or otherwise objectionable content
• Introduce viruses, worms, or malicious code or engage in DDoS attacks or similar activities
• Circumvent, disable, or interfere with the security-related features of the Service
• Attempt to probe, scan, or test the vulnerability of the Service or breach any security or authentication measures
• Create multiple accounts or share accounts between multiple users
• Automate interactions with the Service without express permission

4. Intellectual Property

All content, features, and functionality of the Service, including but not limited to all information, software, text, displays, images, video, and audio, as well as the design, selection, and arrangement thereof, are owned by Publast, its licensors, or other providers of such material and are protected by copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.

5. Payments & Credits

Credits purchased through the Service are non-refundable except as expressly provided in our Refund Policy. All sales are final. Prices for credits are subject to change, but changes will not affect previously purchased credits.

6. No Performance Guarantee

Publast aims for high search and AI visibility but expressly makes no guarantees or warranties of any kind regarding specific rankings, traffic levels, conversion rates, backlink indices, engagement, visibility, or any other performance metrics. Results vary significantly by niche, competition, market conditions, algorithm changes, search-engine policies, and numerous other factors outside of Publast's control. All content generation, placement, and outcomes are provided strictly on an "as is" basis without any guarantees. Past performance should not be considered indicative of future results.

7. Disclaimers & Limitation of Liability

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied. Publast disclaims all warranties, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. Publast does not warrant that the Service will be uninterrupted, timely, secure, error-free, or free from viruses or other harmful components.

Publast's total cumulative liability for any and all claims arising from or related to these Terms or the Service is strictly limited to the lesser of: (a) the amount you paid for credits in the 6 months immediately preceding the claim, or (b) $100 USD.

Under no circumstances will Publast be liable for any indirect, incidental, special, punitive, exemplary, or consequential damages, including lost profits, revenue, data, goodwill, or other intangible losses, regardless of whether such damages were foreseeable and whether or not Publast has been advised of the possibility of such damages.

8. Indemnity

You agree to defend, indemnify, and hold harmless Publast, its officers, directors, employees, agents, licensors, and service providers from and against any and all claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including (including reasonable attorneys' fees) arising out of or relating to: (a) your use of the Service; (b) your Content; (c) your violation of these Terms; (d) your violation of any rights of a third party; or (e) your conduct in connection with the Service.

9. Third-Party Links

The Service may contain links to third-party websites or services that are not owned or controlled by Publast. Publast has no control over, and assumes no responsibility for, the content, privacy policies, or practices of any third-party websites or services. You further acknowledge and agree that Publast shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with the use of or reliance on any such content, goods, or services available on or through any such websites or services.

10. Privacy Policy

Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review our Privacy Policy, which explains how we collect, use, and disclose information about you.

11. Communication

By creating an account on our Service, you agree to subscribe to newsletters, marketing or promotional materials and other information we may send. However, you may opt out of receiving any, or all, of these communications from us by following the unsubscribe link or instructions provided in any email we send.

12. User Content

You retain all rights in the content you provide to the Service ("User Content"), but you grant Publast a non-exclusive, transferable, sublicensable, royalty-free, worldwide license to use, modify, reproduce, distribute, create derivative works of, display, and publish User Content in connection with the Service.

13. Creator Ownership

Publast owns all rights, title, and interest in and to the content generated by the Service, including all associated intellectual property rights. You may use the content only as permitted by the Service and these Terms.

14. Disclaimers & Limitations

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied. Publast disclaims all warranties, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. Publast does not warrant that the Service will be uninterrupted or error-free, that defects will be corrected, or that the Service or the servers that make it available are free of viruses or other harmful components.

In no event shall Publast, its officers, directors, employees, or agents be liable for any indirect, punitive, incidental, special, or consequential damages arising out of or in any way connected with the use of the Service, whether based on contract, tort, strict liability, or otherwise, even if Publast has been advised of the possibility of such damages. In no event shall Publast's aggregate liability exceed the amount paid by you to Publast in the preceding 12 months.

15. Severability

If any provision of these Terms is held to be unenforceable or invalid, such provision will be changed and interpreted to accomplish the objectives of such provision to the greatest extent possible under applicable law and the remaining provisions will continue in full force and effect.

16. Termination

• You may cancel at any time by contacting support.
• Publast may suspend or terminate your account for breach of these Terms or misuse of the Service.
• Unused credits at termination are handled per the Refund Policy.

17. Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of South Korea, without giving effect to any principles of conflicts of law. Any dispute, controversy, or claim arising out of or in connection with these Terms, or the breach, termination, or invalidity thereof, shall be finally settled by arbitration in accordance with the Rules of Arbitration of the International Chamber of Commerce by one or more arbitrators appointed in accordance with the said Rules. The seat of arbitration shall be Seoul, South Korea. The language of the arbitration shall be English.

You agree that any arbitration shall be conducted on an individual basis and not in a class, consolidated, or representative action. Notwithstanding the foregoing, Publast may seek injunctive or other equitable relief to protect its intellectual property rights in any court of competent jurisdiction.

18. Changes to Terms

Publast reserves the right, at its sole discretion, to modify or replace these Terms at any time. If we make changes, we will post the revised Terms on the Site and update the "Last updated" date. For material changes, as determined in our sole discretion, we will provide additional notice, such as by sending an email notification or by posting a prominent notice on our Service prior to the change becoming effective. Your continued use of the Service after any such changes constitutes your binding acceptance of the revised Terms. It is your responsibility to review these Terms periodically for changes. If you do not agree to the revised Terms, you must stop using the Service.
